Please read these Terms of Service carefully before using Everfare's website or services. By using our site or engaging our services, you agree to be bound by these Terms. 1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Everfare LLC, a Wyoming limited liability company ("Everfare," "we," "us," or "our"), and any applicable state-level Everfare entity operating in the jurisdiction where services are rendered (collectively, the "Everfare Entities").

By accessing or using the Everfare website at www.everfare.net (the "Site"), submitting any information through our online forms, or engaging Everfare for cremation or pre-planning services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, do not use the Site or our services.

2. Description of Services

Everfare is a technology-enabled direct arrangement provider. We operate as an online-first platform that connects families with licensed funeral service professionals and cremation facilities to facilitate simple, dignified arrangements. Everfare does not operate a traditional funeral home and does not offer in-person arrangements, viewings, visitation services, or funeral ceremonies.

The services we provide include:

  • Online arrangement intake for immediate-need (at-need) cremation services
  • Online pre-planning and pre-funding of cremation arrangements
  • Coordination of transportation of the deceased
  • Coordination of cremation through licensed partner crematories
  • Assistance with death certificate filing and vital records processing
  • Return of cremated remains by mail to the designated address
  • Digital document execution for all required legal authorizations

All cremation services are performed by or through licensed funeral establishments and crematories operating in compliance with applicable state law. The specific licensed entity providing services in your state will be identified in your service agreement.

3. Eligibility and Authority

3.1 Age Requirement

You must be at least 18 years of age to use the Site or engage our services.

3.2 Legal Authority

By submitting an arrangement request or pre-planning agreement, you represent and warrant that you are the legally authorized next-of-kin or designated agent with the legal right to authorize cremation of the deceased under applicable state law. You further represent that no other person with equal or superior legal authority has objected to the cremation.

The legal priority of next-of-kin authorization varies by state. You are solely responsible for ensuring you have the legal right to authorize cremation before engaging our services. Everfare relies on your representations and is not responsible for disputes arising from competing claims of authority.

3.3 Accuracy of Information

You represent that all information you provide to Everfare — including information about the deceased, your identity, your relationship to the deceased, and payment information — is accurate, complete, and truthful to the best of your knowledge. Providing false or misleading information may constitute a criminal offense and will void any service agreement with Everfare.

4. Online Arrangement Process

4.1 Fully Remote Process

Everfare's arrangement process is conducted entirely online and by telephone. We do not offer in-person meetings, office visits, or physical document signing. All required legal authorizations are executed via electronic signature in compliance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state electronic signature laws.

4.2 Information Collection

To initiate services, you will be required to provide personal information about yourself and the deceased, including but not limited to: full legal name, date of birth, date of death, Social Security number, place of death, and next-of-kin information. This information is used solely to fulfill the services you have requested and to comply with legal requirements for death certificate filing and vital records.

4.3 Document Execution

You will be required to review and electronically sign a cremation authorization form and related service agreement before services commence. You agree that your electronic signature carries the same legal weight as a handwritten signature. You are responsible for carefully reviewing all documents before signing.

4.4 Service Commencement

Services will not commence until all required documentation has been executed, payment has been received, and the deceased has been transferred into Everfare's care. Everfare reserves the right to decline service at its sole discretion.

5. Pricing and Payment

5.1 All-Inclusive Pricing

Everfare offers a single, all-inclusive direct cremation package. The current price is clearly disclosed on our Pricing page. The stated price includes all services described in the package and there are no hidden fees, upsells, or additional charges for standard services.

5.2 Payment

Payment is due in full prior to the commencement of services unless otherwise agreed in writing. We accept major credit cards and electronic bank transfers. All payment processing is handled by a third-party payment processor (currently Stripe, Inc.). Everfare does not store your full payment card information on our servers.

5.3 Pre-Planning and Pre-Funding

For pre-planned arrangements, funds may be held in trust or through a licensed insurance product in accordance with applicable state law. The specific terms of pre-funded arrangements, including cancellation and refund rights, will be set forth in a separate pre-need agreement provided to you at the time of purchase. Pre-need arrangements are subject to the laws of the state in which services are to be performed.

5.4 Refunds

For at-need (immediate) services, refunds are not available once the deceased has been transferred into our care and cremation has commenced. If services are cancelled prior to transfer, a refund will be issued minus any costs already incurred. For pre-planned arrangements, cancellation and refund rights are governed by the applicable state pre-need statute and the terms of your pre-need agreement.

6. Licensed Operations and Partner Entities

Everfare operates through a network of licensed funeral establishments and crematories. All cremation services are performed by or in partnership with entities holding valid licenses under applicable state law. The specific licensed entity responsible for services in your jurisdiction will be identified in your service agreement and on our Licenses page.

Everfare LLC (Wyoming) serves as the parent technology and operations company. State-level Everfare entities are established in each state where services are offered and hold the appropriate state funeral service licenses. Currently, services in Minnesota are provided through Everfare's licensed funeral establishment at 14850 Garrett Avenue, Apple Valley, Minnesota 55124, and cremation is performed at Great River Crematory (Minnesota Department of Health License No. 9097) at 3075 Vermillion Street, Hastings, Minnesota 55033. Current license information is listed on our Licenses page and updated as new licenses are issued.

7. Limitations of Service

Everfare provides direct cremation only. We do not provide:

  • Funeral ceremonies, memorial services, or graveside services
  • Embalming or body preparation for viewing
  • Caskets, urns, keepsakes, or memorial jewelry
  • Grief counseling or bereavement services (though we can provide referrals)
  • In-person meetings or office visits of any kind

If you require services beyond direct cremation, we encourage you to contact a full-service funeral home in your area.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Everfare LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.

9. User Conduct

You agree not to use the Site to:

  • Provide false, fraudulent, or misleading information
  • Impersonate any person or entity
  • Interfere with or disrupt the operation of the Site
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation

10. Disclaimer of Warranties

The site and all services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Everfare does not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Everfare and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the site or our services, even if advised of the possibility of such damages.

In no event shall Everfare's total liability to you for all claims arising out of or relating to these terms or our services exceed the total amount paid by you to Everfare for the services giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Everfare and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any dispute arising from your representation that you had legal authority to authorize cremation of the deceased.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

You waive your right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, disputes relating to the performance of licensed funeral services in a specific state may be subject to the jurisdiction and regulatory authority of that state's funeral regulatory board.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site or our services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
